About the Role

The role will be split between commercial and commercial property. It is envisaged that this will be a 50/50 split over the working week. The duties will involve advising internal clients and liaising with other third parties in the giving of commercial and commercial property advice and the drafting of legal documents. The role will be primarily focused on dealing with both the commercial and property related aspects of Academy conversions under the Academies Act 2010. It will also involve a broad range of commercial work from Care Services to Construction, with advice relating to state aid, grant funding and a variety of commercial matters. In addition there will be a wide range of commercial property work, such as sales, purchases, conditional contracts, commercial leases (acting for both Landlord and Tenant), easements and wayleaves.

Key Accountabilities

1. Drafting and negotiating complex legal documents relating to a wide range of commercial property transactions, together with the ability to advise both in writing and orally on law and practice relating to the structure of such transactions and commercial property law.

2. Drafting commercial documents such as contracts for goods services and works, grant funding agreements

3. Providing advice on existing commercial arrangements

4. Providing advice relating to the Public Contracts Regulations 2015 and State aid

5. Providing advice on all aspects of commercial property work including sales, purchases, auctions, landlord and tenant work, s123 Best Value considerations, and title issues.  

6. Commercial Dispute resolution where necessary (pre-litigation).

7. General commercial and commercial property advice.

Skills and Experience

Ideally we are looking for a candidate with a demonstrable commercial and commercial property background within a local authority setting and credit will be given for the breadth and depth of experience that a candidate can demonstrate. However, we will consider lawyers (including newly qualified solicitors ) with relevant experience of both or just one of the two areas of law from any setting provided  they can demonstrate a strong work ethic, a professional attitude, a desire to work in local authority and (where necessary) a willingness gain experience in a new area of law.
